Conduct Regulations
The Conduct of Employment Agencies and Employment Businesses Regulations 2003 (“Conduct Regulations”) set out requirements for employment agencies and employment businesses that introduce or supply workers to hirers. This page explains how those regulations relate to Beacon People Limited and the supply chain we operate in. It is for information only and does not constitute legal advice.
1. What the Conduct Regulations cover
The Conduct Regulations impose obligations on “employment agencies” (which find work for workers) and “employment businesses” (which supply workers to work under the direction of a hirer). Those obligations include: requirements as to the information that must be given to workers and hirers; restrictions on charging fees to workers in certain circumstances; and rules about terms and transparency. The regulations are enforced by the Employment Agency Standards Inspectorate (EAS).
2. Beacon People’s role
Beacon People Limited is an umbrella company. We employ contractors who work on assignments that are typically arranged or supplied by recruitment agencies or employment businesses. We do not find work for workers or supply workers to hirers in the way that an employment agency or employment business does; we provide payroll and employment services to individuals who are already being placed or supplied by others. Accordingly, we are not subject to the Conduct Regulations in the same way that agencies and employment businesses are.
However, we work closely with agencies and hirers. We expect the agencies we work with to comply with their own legal obligations, including under the Conduct Regulations where they apply. We support transparency and good practice in the supply chain by providing clear documentation, payslips, and processes that help workers and agencies understand how we operate.
3. Your rights as a worker
If you are supplied by an agency or employment business, that entity may have obligations to you under the Conduct Regulations (for example, to provide certain information about the role and terms). As your employer, we have obligations to you under employment law and under our contract with you. If you have questions about your rights or the role of the agency versus the umbrella, you may wish to seek independent advice. We are happy to explain our role and our processes.
